Terms of Service

By creating an account and using NGX Web Solutions services, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of NGX Web Solutions's email infrastructure platform, including our SMTP relay, business email hosting, and all related services (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not use the Service to:

• Send unsolicited bulk email (spam) to recipients who have not opted in
• Transmit malware, phishing content, or other malicious material
• Impersonate another person or organization without authorization
• Violate any applicable law or regulation, including CAN-SPAM, GDPR, and CASL
• Send email that violates the policies of receiving mail providers
• Attempt to bypass rate limits, security controls, or abuse filters

We reserve the right to suspend or terminate accounts that violate this Acceptable Use Policy without prior notice.

3. Account Responsibilities

You are responsible for maintaining the security of your account credentials, including your portal login and SMTP passwords. You are responsible for all activity that occurs under your account. Notify us immediately at support if you suspect unauthorized access.

4. Service Availability

We strive to maintain 99.9% uptime for the SMTP relay and customer portal. Scheduled maintenance will be announced in advance when possible. We are not liable for service interruptions caused by factors outside our reasonable control, including upstream network outages, force majeure events, or third-party provider failures.

5. Fees and Payment

Fees are charged as described on the Pricing page. All fees are due in advance of the billing period. Failure to pay may result in service suspension. We reserve the right to change pricing with at least 30 days' notice to active customers.

6. Limitation of Liability

To the maximum extent permitted by law, NGX Web Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the fees you paid us in the three months preceding the claim.

7. Termination

You may cancel your account at any time through the portal or by contacting support. We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or for any other reason with reasonable notice (except in cases of immediate abuse where termination may be instantaneous).

8. Changes to Terms

We may modify these Terms from time to time. We will provide at least 14 days' notice of material changes via email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction as agreed by the parties.
